By joining into a membership at Physician Life Booster, LLC, (hereafter referred to as “PLB”), you agree to the following policies, procedures, and practices to enable you to get the most out of this program.

Coaching is a partnership in a process to inspire the client to maximize personal and professional potential.

Disclaimer:

Coaching is not medical or mental health treatment. You acknowledge that while Juliette Galbraith, MD, and Tracy Levitt, MD, are physicians, they are not your physicians and are serving in this practice solely as coaches. Coaching does not involve the diagnosis or treatment of mental disorders as defined by the American Psychiatric Association and that coaching is not to be used as a substitute for counseling, psychotherapy, psychoanalysis, mental health care, substance abuse treatment, or other professional advice by legal, medical or other qualified professionals. It is your exclusive responsibility to seek such independent professional guidance as needed.

Ethics:

You understand that PLB coaches will maintain the ethics and standards of behavior established by the International Coach Federation “(ICF)” (Coachfederation.org/ethics).

Confidentiality:
Coaching is a confidential professional relationship. Juliette Galbraith and Tracy Levitt and other physician coaches will treat this information with the utmost respect and confidentiality. The coaching profession does not have a legally binding coach-client confidentiality clause in the way that other professions do, and that Physician Life Booster voluntarily chooses to protect all their clients in this way. You agree that you will also maintain confidentiality of your fellow PLB members and will not discuss, write about, post on social media about any specific personal situations, names or identifying information, or specific work situations that are discussed during any PLB groups or events. While you may post on social media about the existence of the PLB program, you may not post any other specific details discussed in groups.

Client Expectations:
Here at PLB we are here to support one another.
You agree to the following expectations:

  • Supporting your fellow group members by adding positivity and supportive comments and tips in the chat during group coaching sessions.
  • Making every effort to join the virtual groups from a quiet, distraction-free, private setting and have your video turned on. Joining on time and staying for the duration of the group, barring emergencies.
  • Being respectful of your fellow group members and not sharing specific personal information outside of the groups (as noted above in the confidentiality section).
  • Using the recordings, resource material, and other program information only for your own personal development purposes. You will not use or reuse our materials for any financial gain or otherwise distribute to any third parties without the express written permission of Physician Life Booster, LLC.

Purchases and Online Commerce
You give PLB permission to automatically charge your credit or debit card as payment for monthly membership fee, for which you will receive an electronic receipt.

In the event that payment is not received by the date due, you will have a five (5) day grace period to make the payment otherwise the membership will not continue and we reserve the right to cease your access immediately.

All information obtained during your purchase or transaction for our Programs, Products and Services and all of the information that you give as part of the transaction, such as your name, address, method of payment, credit card number, and billing information, may be collected by both PLB and our payment processing company.

Dispute Resolution
Informal Negotiations
To expedite resolution and control the cost of any dispute, controversy, or claim related to these Legal Terms (each a "Dispute" and collectively, the "Disputes") brought by either you or us (individually, a "Party" and collectively, the "Parties"), the Parties agree to first attempt to negotiate any Dispute (except those Disputes expressly provided below) informally for at least thirty (30) days before initiating arbitration. Such informal negotiations commence upon written notice from one Party to the other Party.

Binding Arbitration
If the Parties are unable to resolve a Dispute through informal negotiations, the Dispute (except those Disputes expressly excluded below) will be finally and exclusively resolved by binding arbitration. YOU UNDERSTAND THAT WITHOUT THIS PROVISION, YOU WOULD HAVE THE RIGHT TO SUE IN COURT AND HAVE A JURY TRIAL. The arbitration shall be commenced and conducted under the Commercial Arbitration Rules of the American Arbitration Association ("AAA") and, where appropriate, the AAA’s Supplementary Procedures for Consumer Related Disputes ("AAA Consumer Rules"), both of which are available at the American Arbitration Association (AAA) website. Your arbitration fees and your share of arbitrator compensation shall be governed by the AAA Consumer Rules and, where appropriate, limited by the AAA Consumer Rules. The arbitration may be conducted in person, through the submission of documents, by phone, or online. The arbitrator will make a decision in writing, but need not provide a statement of reasons unless requested by either Party. The arbitrator must follow applicable law, and any award may be challenged if the arbitrator fails to do so. Except where otherwise required by the applicable AAA rules or applicable law, the arbitration will take place in Philadelphia, Pennsylvania. Except as otherwise provided herein, the Parties may litigate in court to compel arbitration, stay proceedings pending arbitration, or to confirm, modify, vacate, or enter judgment on the award entered by the arbitrator.

If for any reason, a Dispute proceeds in court rather than arbitration, the Dispute shall be commenced or prosecuted in the  state and federal courts located in Philadelphia, Pennsylvania, and the Parties hereby consent to, and waive all defenses of lack of personal jurisdiction, and forum non conveniens with respect to venue and jurisdiction in such state and federal courts. Application of the United Nations Convention on Contracts for the International Sale of Goods and the Uniform Computer Information Transaction Act (UCITA) are excluded from these Legal Terms.

In no event shall any Dispute brought by either Party related in any way to the Services be commenced more than one (1) years after the cause of action arose. If this provision is found to be illegal or unenforceable, then neither Party will elect to arbitrate any Dispute falling within that portion of this provision found to be illegal or unenforceable and such Dispute shall be decided by a court of competent jurisdiction within the courts listed for jurisdiction above, and the Parties agree to submit to the personal jurisdiction of that court.

Restrictions
The Parties agree that any arbitration shall be limited to the Dispute between the Parties individually. To the full extent permitted by law, (a) no arbitration shall be joined with any other proceeding; (b) there is no right or authority for any Dispute to be arbitrated on a class-action basis or to utilize class action procedures; and (c) there is no right or authority for any Dispute to be brought in a purported representative capacity on behalf of the general public or any other persons.
